Licensing and copyright questions
You can use the Filter Library filters for commercial or non-commercial purposes as long as you don't violate the law or someone else's rights. |
Ok so I was recently browsing through the FF library, and happened upon this:
Quote |
---|
3D Textures are merge all your textures before offering you final product for sale, NO Textures sets may be sold with any of my filters.
|
And I tottaly respect this, however I was just wondered if this is someone elses "rights."
With that note, does that mean all other filters without expressed concern for others use in commercial products are fair gain to anyone owning a legal copy of FF? Cause I was considering submiting a texture image for a game that would go commercial, and I wanted to create my own filter using others compiled work (cuts and pieces).
I hope I have been clear, Im just interested if all filters are subject for commercial use unless otherwise expressed by the author. We walk through life building our castles but far to many cease to build the foundations.

btw IANAL
As per my understanding of the EULA and the uploading license ALL the filters as of this point are free to do with what the users and customers want...ie..selling, distributing the textures in any way they wish....No matter what notes you will find in the submitted filters the notes are rendered null and void due to FFs upload lic so its just typing extra info for no reason...Simply put if you want no one selling them don't submit them...ya ya I know but its the only system we got for now...
However the filters and textures that are posted in the fourms themselves are not bond by the upload lic and are a different matter all together.....
But its always good manners to come back to the FF foums and thank those whose filters you used..
Also its good manners to mail the filters creator and ask but not a required step..
But thats just me...
Hope this has helped explain this a bit... Stupid things happen to computers for stupid reasons at stupid times!

and whereas i agree with CF&M, you still need to read and understand both the upload eula and the user's eula. taking anything from the forums as 'legal' is pure folly. read your contract; that's the ONLY thing that pertains. If wishes were horses... there'd be a whole lot of horse crap to clean up!

You may think of such filter notes as of polite requests. The author cannot legally restrict the commercial usage of his/her filters but asks not to do this. You can ignore this request but this will probably cause bad karma.

----Says who ? As if the FF Eula would hold up in court any better than someone's personal legal usage limitations statement. Not that anyone is making enough money off of filter renders to ever get sued ha-ha. All the legal mumbo-jumbo gets old, once it's out there in the digital-world, it can and will be stolen/used however someone wants to use it, and until they start making more than a legit user or the creator (assuming either of those persons has the money/time/inclination to do so), there is less than zero risk of any legal action what-so-ever.

Yep not a requirement step but just polite and respectful...
But you can always use the contact tab and ask the FF team directly....

Umm.... says ... the .. Berne Convention of Artistic Works, US Treaties, and the body of legal tradition.
I can say "Anyone who replies to this post agrees to send me, at their own expense, one gift-wrapped fifth of Jack Daniels." But that's not 'enforceable'. People have a lot of misconceptions about what's copyright-able and what isn't.

Well, what the FF Eula says, essentially, is what you make is yours to use / sell, as you will whatever. So... that door is pretty open. But yeah: if you REALLY don't wan't people making / selling things with your filter, then don't post it!

Yea from reading FF Eula I was under the impression that by submiting the filter your giving it as a public resource to anyone who has a liscenced copy of FF. Thanks for clarifying, we might wanna close this down before someone actually tries to =P We walk through life building our castles but far to many cease to build the foundations.
