Just came across this browsing at Amazon:

Repeatable Backgrounds--Geometric and Abstract Patterns CD-ROM and Book

Generally OK, but take a look at the textures in use on that book, anything seems familiar ?

Lets see, there is:

Dimetric Q*Bert
Modern Quilt Block Variation 8
Truchet Tiling Remixed
Steps
Funny ceramic tillies

And those are just the ones I recognized instantly. The book has not come out yet, but want to bet it lists sources and gives creators for these textures when it does ? Me, I'm betting whoever it is doesn't, he doesn't have to after all smile:evil:

I might, once they are in print and don't list their sources. Its still remotely possible though that the guy has bought a copy of FForge (which would give him full rights to use those textures in any way he sees fit, including resale as a book) and lists full credits. If not,... I intend to write a comment.

i would also, sjeiti. i'm bad enough that when i use someone's art type filter for a photo art piece, that i even tend to credit the filter or filter artist or both. not always, but often enough.

----About ? It'll be about 48 pages long, and most likely it'll just show the graphics that are on the cd-rom, like a catalog/referrence. If it were just one big "book" (instead of the 2 or 3 seamless tiles ones he has listed on Amazon there), I'd maybe think it was to show people how to use seamless tiles in their work, and it would make perfect sense to include 25-50 royalty free seamless tiles for people to learn/practice with on the cd-rom. Which in and of itself, is a great idea for a book. smile:)

The question though is, did the guy buy a license to the software or not? If he did,... well, without that new Acceptable Use Policy, what he did is legal. He has the rights to use whatever textures his copy generates for whatever purpose he wants to use it for. Even with the new AUP in force, the older filters will still be grandfathered into allowing him to do so. Does that make it ethical? No, or at least only if he gives full and proper credit to the filters used in my opinion. Whether he does so will remain to be seen.

As to that license,... Vladimir, I think only you can check that. He has to be using a copy of FForge to generate his images, since at least *some* of them aren't pregenerated variants of the filter directly downloadable from their filter's pages here on www.filterforge.com , but is it a free copy or a commercial one ?

Why is it unethical for a publisher to accept an agreement and abide by it? Especially when it is somewhat the industry standard to be able to publish renderings that are not made from filters created by the publisher. Spiral Graphics not only allows it, they use it as a promotional point. Alien Skin has no objection either. The EULA as presented by Filter Forge to any potential licensee does not even address the question.

Further, to say or imply that Filter Forge, Inc. is being ripped off is the complete opposite of what has happened in the instance under discussion and in numerous other instances that have already been pointed out in past threads. Filter Forge, Inc. benefits from such exposure and sells more programs as a result.

Whether your wish as filter artists is to be financially compensated or professionally credited or both, that is something that requires action on your part. By that I mean that you should be seeking to publish and market yourself or contract with someone to do it for you. Posting claims of bad ethical conduct about publishers who are very likely not even aware of the situation serves little purpose IMHO.

As a publisher and marketer of high resolution seamless tiles, I will tell you that having your work published in return for royalties and professional crediting is a door you can open and walk through. Or you can sit and watch while others use your donated filters in full accordance with the terms and conditions under which they acquired a license for Filter Forge.

We have licensing agreements with three of the better known filter artists here and have purchased non-exclusive rights to a number of filters from a fourth. We are just now loading one of our websites with their renderings and have begun plans for a second site that will be specifically aimed at buyers of tiles and high resolution fills.

I kind of have a different outlook on these sellers nowadays..When I talk to people I always say you can see some of my work here and here..Then I always point to those sites where my filters are being used.. smile:)
