Interesting.
I have to say both sides have a point. Hard to decide who is "right" and who is "wrong". I still think that if the original artist asks you to remove your plugin, you should. |

Yes, the point really is that he was using tiles of Chucks actual artwork in his filter which is total unexceptable, you also can't copyright a style of painting. In fact you could paint an exact copy of one of Chucks painting stroke for stroke and as long as you don't sign it Chuck Close or try and sell it as an original Chuck Close you have not broken any laws. Now the Pacman filter in the library is different matter, that is a registered Trademark.

i believe carl is right. you cant copyright a style. however, using his name in your filter would or could be a violation. you cant use someone else's name or likeness for commercial gain without their permission. this is why you see faces blurred out sometimes on tv.
but, i could be wrong on all of the above. your best bet is to check out the actual copyright laws on: http://www.copyright.gov/ If wishes were horses... there'd be a whole lot of horse crap to clean up!

I think this is the key point here... If you submit it to the library you practicly can't use it commercialy. Remember that all the filters are uncopyrighted, and you can't sell a filter, hence you can't use someone else's name or likeness for commercial gain. I didn't know in his plugin he used actual scans of actual works. That is totaly unaxceptable and offensive. If someone copies you style, take it as a compliment. If someone copies your work, take it to court. ![]() |

whoa, whoa, whoa... be VERY specific here, morgantao! you absolutely can use a filter commercially if you submit it to the library. and, all filters ARE copyrighted! read the author's eula and the end user's eula. you retain all copyrights to any filter you submit to the library. you are simply granting filter forge, inc. the right to use and distribute it. and i'd have to go look again, but i think you're granting them exclusive right, meaning once you submit it to the library you couldnt then sell it somewhere else. though, i dont know who would buy it once it was in the library. but, even if your filter is in the library, you still retain the copyrights.
also, any filter you DON'T submit to the library you have the copyright to. and, you could sell that one. i think i know what you were trying to say, but when talking about copyrights you want to be very clear and very specific! ![]() also, one shld be very careful about the 'commercial gain' thing. in most cases i've seen, commericial gain or not is irrelevant. if you copy a copyrighted work, even if it's just to put on your facebook page, for instance, you could still be sued, even though there was no commercial gain involved. it shld also be pointed out that i'm only talking about american copyrights here. i know there are differences in other countries. and again, visit the copyright site and study copyrights. all artists shld have a good working knowledge of what's actually legal and what's not. ![]() I can't read law, it's a foreign language to me. I get a headache just thinking about copyright laws, it seems to be the most complex area of law. |
